Idaho Reproductive Laws

Idaho has one of the strictest abortion bans in the country. Idaho's current laws allow for abortion only to save the mother's life, or if the pregnancy was a result of rape or incest (with a police report filed, and only within the first trimester). A mandatory 24-hour waiting period and state-mandated counseling apply where abortion is legally permitted. Public funding and private insurance coverage for abortion are both restricted under state law. A 2025 court ruling clarified that abortion is allowed in Idaho when a pregnancy involves complications or health conditions that endanger the life of the pregnant person, and providers cannot be prosecuted for care given in those circumstances. However, serious mental health conditions are not a legally justifiable exemption, and pregnancies with a fatal fetal diagnosis are also not exempt. Idahoans can legally travel out of state for abortion care, and helping someone travel for care, or providing care to an Idaho resident in another state, is legal. (The exception is helping a minor travel without parental consent). A minor generally needs written parental or guardian consent to obtain an abortion, with a judicial bypass option (a minor can ask a judge for approval instead). Minors in Idaho can still get contraception without parental permission, and confidentiality protections generally apply. In late 2025, Idaho declined its federal Title X family planning funding, leading most of the state's low-cost family planning clinics to close. Over 40% of the doctors who left moved out of state entirely. An OB-GYN who'd practiced in Idaho for nearly 30 years left for Washington after concluding she couldn't safely continue practicing under the threat of criminal and civil liability. Three Idaho health systems have shut down their labor and delivery services in recent years. Bonner General Health in Sandpoint (a town of about 10,000) ended obstetrical care in March 2023, explicitly citing the state's "legal and political climate" as a factor. Rural doctors warn that when patients face reduced access to care, prenatal complications can go uncaught until they become dangerous for both mother and baby.
